Terms of Service
These Terms of Service ("Terms") govern your access to and use of the agc.chain platform and related services (the "Service"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and the organization you represent.
1. The Service
agc.chain provides a compliance platform that anchors airworthiness certificates (such as the EASA Form 1 and FAA 8130-3) to a private, permissioned blockchain by storing a one-way cryptographic hash of each document, and offers public verification of those records. We may improve, modify or add features over time. The Service supports your compliance processes but does not replace your own regulatory responsibilities or judgment.
2. Accounts and organizations
- The Service is organized into tenants ("organizations"). Access is granted per user within an organization, under role-based permissions.
- You are responsible for the accuracy of your account information, for safeguarding your credentials and authenticator, and for all activity under your account.
- You must enrol and use two-factor authentication where the Service requires it, including for on-chain actions.
- You must promptly notify us of any unauthorized use of your account or any security incident.
3. Subscriptions and billing
- Paid plans are billed in advance on the interval shown at checkout (for example, monthly or annually). Fees, limits and features are those presented for your selected plan.
- Free trials, where offered, convert to a paid subscription unless cancelled before the trial ends.
- Unless stated otherwise, fees are non-refundable and exclusive of applicable taxes.
- You may cancel at any time; cancellation takes effect at the end of the current billing period. We may change pricing with reasonable advance notice.
4. Acceptable use
You agree not to:
- Upload unlawful content, or content you have no right to submit.
- Submit false, forged or misleading certificate data, or misuse the verification features to deceive third parties.
- Attempt to breach, probe or circumvent the security, tenant isolation or access controls of the Service.
- Interfere with the operation of the Service, or use it to build a competing product by improper means.
- Use the Service in violation of applicable aviation, export, data protection or other laws.
5. Your data and intellectual property
As between the parties, you retain all rights to the certificates, documents and data you submit ("Customer Data"). You grant us the limited rights necessary to host, process and display Customer Data to provide the Service. We and our licensors retain all rights in the Service, its software, and our trademarks. The on-chain hash of a record is, by nature, a permanent and immutable integrity anchor.
6. Availability and support
We aim to keep the Service available and performant, but it is provided on an "as is" and "as available" basis. Planned maintenance and support levels may vary by plan.
7. Disclaimers
To the maximum extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that verification results substitute for your own regulatory determinations.
8. Limitation of liability
To the maximum extent permitted by law, agc.chain shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill. Our aggregate liability arising out of or relating to the Service shall not exceed the amounts paid by your organization for the Service in the twelve months preceding the event giving rise to the claim.
9. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access for material breach of these Terms, non-payment, or where required by law. Certificate records and their audit trail are retained as permanent, non-deletable records by design; upon termination we will handle personal data in accordance with our Privacy Policy.
10. Governing law
Governing law and jurisdiction to be specified. These Terms will be governed by the laws of the jurisdiction stated here, without regard to conflict-of-law principles, and the courts of that jurisdiction will have exclusive jurisdiction over any dispute.
11. Changes to these Terms
We may update these Terms as the Service evolves. Material changes will be communicated through the platform, and continued use after the changes take effect constitutes acceptance. The "Last updated" date above reflects the current version.
